The increase in greenhouse gas emissions resulting from human activity is directly related to a large number of extreme phenomena such as high temperatures, floods, fires, loss of biodiversity and many phenomena that directly affect human health and the environment.. France has witnessed a great movement in the issue of climate change by citizens and civil society organizations driven by official reports that increase their fears and the success of the Urgenda Foundation in the Netherlands, which resulted in two lawsuits being filed before the French administrative court, the first in the province of Grande Synthe and the other case of the Century Affaire du siècle, in order to face the state's climate inaction and compel it to adopt more ambitious policies. These lawsuits raise a number of legal problems, such as determining the element of error on the side of the state and the environmental damage and the possibility of compensation for it, and the causal relationship between the error and the plaintiff damage, which is a major obstacle before the judge in climate lawsuits in general, which requires the judge to follow a flexible and innovative approach at the same time to overcome it this is the problem .
