Profit is a right given to the shareholder to take, it is a natural original right and not a probable right. Therefore, there no work without facing some problems that hinder its success. There are many problems that faced the rules of dividing the profits, most important of which are:- • Problem of deducting part of the profit to form the hidden reserve, whereas this reserve is not deducted for the benefit of the company, but rather it is deducted for the beneficiaries group only. • Second problem is distributing the fixed interest, whereas a group of company's in charge suggest on the company a fixed interest from the profit or from the capital, regardless the company achieved profit or loss, there main aim is to seek to take this interest. • Third problem is distributing the formal profits on the shareholders which the company has not made, it is being distributed from the capital on the partners, to make them believe in the success of their management. • Fourth problem is arbitrariness of the general assembly in distributing the profit on the shareholders, their purpose is the exclusive possession of such profits. • Fifth problem is distributing the profit on shareholders without cash commitment and claim the debtors of their due rights, and the company ignore this for the distribution. This research aim is to find realistic firm solutions for these problems, we try as much as we can we seek to fulfill that, we may share even partially to get out of these problems. I followed an analytical, deductive and inductive methodology for these problems, the examine its suitability from the jurisprudence aspect. The research concluded many approaches.
