Various constitutions have addressed freedom of expression as a fundamental right of citizenship. The exercise of this human right, however, adapts to the changing mediums or spaces through which it is expressed. This research paper explicitly focuses on the exercise of the right to freedom of expression via the internet and digital platforms, which offers opportunities to deepen and reinforce the practice of this freedom but also presents a range of unprecedented legal challenges in the lived reality. The framework of digital citizenship assigns responsibility to individuals for the consequences of their actions online, in accordance with general rules and specific laws that have emerged to regulate actions and practices across various modern technologies. The primary aim of this research paper is to examine digital citizenship within the context of international treaties, which—by necessity—constitute binding law in all signatory states and are enforceable within them. The paper observes both international and national developments in addressing the right to expression generally, and more specifically, the right to expression in digital and technological environments. Moreover, the paper delves into some local legal contributions to this domain, which in many cases may rightly be characterized as legal innovation. This exploration highlights how countries are navigating and shaping the relationship between freedom of expression and the challenges posed by digital technologies, emphasizing the interplay between global frameworks and local initiatives.
