The world has witnessed unprecedented advancements in the use of modern technologies, such as the internet, social media, and artificial intelligence, which have created significant opportunities for enhancing fundamental rights. However, these advancements have also posed serious challenges to constitutional rights, chief among them being the right to privacy. The right to privacy is a fundamental right recognized by national constitutions and international conventions. Yet, the proliferation of modern technologies has introduced a new reality marked by an increasing potential for violations of this right. This study aims to review and analyze the impact of modern technologies on the right to privacy by examining the constitutional and legal framework of this right and its historical evolution. It discusses the right's status in national and international legislation and focuses on the legal challenges arising from modern technology by presenting real-world examples of privacy violations. Furthermore, it explores constitutional and legal mechanisms capable of safeguarding this right in the digital age. The study also examines the role of constitutional judiciary in addressing violations resulting from technological advancements and underscores the importance of updating national legislation to align with international standards for protecting personal data and ensuring privacy. Finally, the research offers recommendations to enhance the balance between leveraging modern technologies and safeguarding constitutional rights, aiming to establish more effective guarantees for the right to privacy.
