Abstract:
The right of veto was sanctified and enshrined in the Charter of the United Nations, with Article 27, Paragraph (3) of the Charter being interpreted in isolation from the rest of its provisions. This approach disregarded the principles of international law and human rights. Consequently, the right of veto has become an obstacle to peace and a contributor to the breach of international peace and security by providing a sense of security for violating states, ensuring they remain unaccountable for their violations due to the ease of exercising this right within the sanctum of the Security Council. While contradictions within the provisions of a single constitution or legal system, regardless of its nature, are common and not unusual, there is always a way to address these issues, either through amendment or the repeal of the less significant provisions. The misuse of the veto power granted to the five major powers has demonstrated its negative impact, ultimately hindering the achievement of the United Nations' objectives. This highlights the necessity of abolishing or restricting its use to align with the goals of the United Nations, namely, the maintenance of international peace and security. However, any amendment to this effect is subject to the approval of those same five powers, who can always exercise their veto against such amendments, trapping international peace and security in a vicious cycle of veto misuse. This study aims to provide a deeper understanding of the importance of upholding international law in addressing the abuse of the veto power at the international level and mitigating its potential negative consequences. It seeks to explore the legality of subjecting veto misuse to judicial oversight by the International Court of Justice, as well as practical mechanisms to ensure effective monitoring of veto abuse and its violations of the fundamental principles of international law.
