It is beyond doubt that protection of personal life is one of the most important determinants of the legal system as this right constitutes a fundamental personal right . Indeed the violation of this right represents an assault on human dignity and that's why the right of each person to his or her photo – as it stands among personal rights - acquires a great protection . The importance of the topic of this research which is the criminal protection of the right to personal photo is derived from the fact that a photo is merely an indication of person's personality , emotions , physical characteristics and lifestyle. Hence, photo is considered one of the sacred elements of human personality. The choice of the abovementioned topic was an outcome of both theoretical and practical considerations . Despite the great practical significance of such right especially as a guarantee for personal liberty and prosperity , the scope and content of the prescribed protection wasn't satisfactorily studied by criminal law researchers . In order to study this topic , it was necessary to deal with the definition of the right to photo and historical development of that right . furthermore , section one was dedicated to discuss the substantive protection of the aforementioned right . while procedural protection was dealt with in section two . The research was concluded with several recommendations that are central from our point of view to preserve consistency between existing legal provisions and technological breakthrough that is taking place nowadays.
